Brand Torrent is an online service offered to enable companies find and connect with other companies interested in cross-promotion activities. To join Brand Torrent you must be 18 years of age and either own or represent a business interested in cross-promotion activities.
This agreement describes the terms on which you may access and use our services. By using this website you accept all of the terms and conditions of this agreement and the Privacy Policy. In the event of any inconsistency between the Privacy Policy and these Terms of Use, the Terms of Use will supercede the authority of the Privacy Policy. User Responsibilities and Conduct
Each Brant Torrent Member is responsible for keeping their password confidential. You are also responsible for activities that occur under your account, with or without your consent or knowledge. If you account becomes breached, you are responsible for notifying Brand Torrent immediately.Brand Torrent users are not permitted to:
- Use brand Torrent for any illegal purpose, including but not limited to conspiring to violate laws.
- Post content or initiate communications which are illegal, defamatory, obscene, threatening, or abusive.
- Post or communicate content that violates patents, trademarks, copyrights or other proprietary rights.
- Post spam.
- Post links to web pages that violate laws and/or regulations.
- Use of any device, software or routine to interfere or attempt to interfere with the proper working of our service, or that interferes with another party's use of our service.
Communications From Brand Torrent
It may be necessary for Brand Torrent to communicate with you via email. You agree to receive necessary email that pertains specifically to your account. Such communications may include account welcome email and password reminders if requested.
Permission to Use Materials Submitted
Members give permission for Brand Torrent to re-use images or text submitted to the Brand Torrent website for promotional purposes.
Warranty
Members acknowledge and agree that Brand Torrent makes no guarantees regarding creating connections between businesses. Members acknowledge that they are using this service at their own risk and that the service is provided "as is".Brand Torrent does not represent or guarantee that access to our service will be uninterrupted or that there will be no failures, errors or omissions or loss of data transmitted to us.
Brand Torrent makes no warranty concerning the quality, safety or legality of the products or services sold by Members.
Liability and Indemnification
Brand Torrent disclaims any liability for the posting of content to our websites that is an infringement on any party's rights or the law. We certify that, based on this document, we have acted in good faith in preventing our membership from misconduct of this kind and shall not be held responsible for claims against our membership.Brand Torrent explicitly disclaims all warranties, expressed or implied, including but not limited to, reliability, merchantability, non-infringement, fitness for a particular purpose or any other warranty condition, guarantee or representation, whether oral, electronic or written. This is also including, but not limited to, completeness or accuracy of any information contained therein.
Brand Torrent shall be released from any and all claims, demands and damages of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with transactions between our Members and/or visitors. Brand Torrent shall not be held liable for damages allegedly sustained arising out of this agreement of use of our services. Furthermore, Brand Torrent shall not be held liable for damages allegedly sustained from the purchase or sale of any goods or merchandise. Members agree to release Brand Torrent from claims, demands or damages of any kind arising out of or in any way connected with use our services.
Brand Torrent users agree to indemnify and hold harmless Brand Torrent, and each Brand Torrent shareholder, director, officer, employee, contractor, or agent from and against any and all liabilities, damages or losses, including reasonable attorneys' fees, arising out of claims, judgments, actions, suits, judicial or administrative orders, or settlements based on (i) allegations that content posted to a website by such Member infringes on the intellectual property or other rights of any person, (ii) any inaccuracy in or breach of the intellectual property certifications (iii) transactions between Members, or (iv) products or services sold or advertised, or claims made in advertising, by such Members or (v) such Member's membership or use of Brand Torrent services.
